Terms of Use — Quest

These Terms of Use ("Terms") govern your use of Quest, the mental health companion application and related websites, including questapp.ai (collectively, the "Service"), provided by Quest ("we," "us," or "our"). By creating an account, starting a free trial, or otherwise using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

Quest is not a medical service. Quest is an AI companion, not a licensed therapist, psychologist, psychiatrist, or medical professional. The Service is not designed for crisis support and does not diagnose, treat, cure, or prevent any condition. If you are in immediate danger or experiencing a mental health emergency, call 988 (US), 999 (UK), your local emergency number, or go to your nearest emergency room.

1. Eligibility

You must be at least 18 years old to use the Service. By using Quest, you represent and warrant that you are at least 18 and that you have the legal capacity to enter into these Terms. Quest is not directed to children under 18, and we do not knowingly collect information from anyone under 18.

2. Your Account

You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us immediately at hello@questapp.ai if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or that we believe pose a risk to other users or to the Service.

3. The Service

Quest provides an AI-driven companion designed to help users reflect, process emotions, track moods, journal, and build daily habits around emotional well-being. The Service includes conversational AI features, journaling, mood tracking, and related content.

Not a substitute for professional care

Quest is not a replacement for therapy, counseling, medical care, medication, or any other form of professional treatment. The AI may make mistakes. Do not rely on Quest for diagnosis, treatment, urgent care, or any decision that has medical, legal, or financial consequences.

Content generated by AI

Responses from Quest are generated by AI systems and may be inaccurate, incomplete, or unsuitable for your situation. We do not guarantee that any output from Quest is correct, safe, or appropriate. Use your judgment, and consult qualified professionals for matters that require professional advice.

4. Subscriptions, Free Trials, and Payment

Quest is offered as a paid subscription. Where available, we may offer a free trial. Subscription terms, pricing, billing frequency, and trial details are presented at checkout and are incorporated by reference into these Terms. 5. Acceptable Use

You agree not to:

Use the Service to harm yourself or others, or to plan or threaten harm;
Attempt to reverse engineer, decompile, or otherwise extract the source code or models underlying the Service;
Use the Service to build a competing product or to train another AI model;
Use automated tools (bots, scrapers, crawlers) to access the Service without our written permission;
Upload or transmit malicious code, viruses, or any content that infringes another party's rights;
Impersonate another person, misrepresent your identity, or share your account with others;
Use the Service in violation of applicable laws or regulations.

6. User Content

You retain ownership of the content you share with Quest, including journal entries, messages, and personal information ("User Content"). You grant us a limited, worldwide, royalty-free license to host, process, store, and display your User Content solely as needed to provide and improve the Service for you. We do not sell your User Content. We do not use the contents of your personal conversations to train AI models offered to third parties.

7. Intellectual Property

The Service, including software, models, text, graphics, logos, and audio, is owned by Quest or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except as expressly granted, no rights are transferred to you under these Terms.

8. Disclaimers

The Service is provided "as is" and "as available," without warranty of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of the course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, secure, accurate, complete, free of errors, free of harmful components, or that any defects will be corrected.

9. Limitation of Liability

To the maximum extent permitted by law, in no event will Quest, its affiliates, or its licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the Service. Our total liability for any claim arising out of or related to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the event giving rise to the claim, or (b) one hundred US dollars (US$100).

10. Indemnification

You agree to indemnify and hold harmless Quest and its officers, directors, employees, and agents from any claim, liability, damage, loss, or expense (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

You may stop using Quest at any time. You can cancel your subscription from Settings inside the app or by emailing hello@questapp.ai. We may suspend or terminate your access at any time for any reason, including violation of these Terms. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Governing Law) will survive.

12. Changes to the Service or These Terms

We may update the Service and these Terms from time to time. If we make material changes, we will notify you, for example by posting a notice in the app or sending an email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles. You agree that any dispute arising out of or related to these Terms or the Service will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
